Summary
This summary helps you read the terms. It is not a substitute for them.
- ConstaSite is a service from ConstaCore Technologies for checking sites, searching areas and producing reports from public data.
- Your workspace belongs to you. Its owners and admins decide who is in it and are responsible for what members do there.
- You pay through Stripe. Plans renew monthly or yearly until you cancel; credit packs last 12 months; single reports do not expire. Refunds are in section 4.6.
- The figures come from public sources that every report names. Use reports for your own business decisions and share them with your lenders, investors and advisers. Do not resell the underlying data as a dataset.
- ConstaSite gives information, not advice. A report is not a survey, an appraisal or a legal opinion.
- Our liability is capped at what you paid us in the last 12 months.
- Texas law applies. Disputes go to the courts in Harris County, Texas. You keep your right to join a class action.
1. These terms
1.1 These Terms of Use (the “terms”) are an agreement between you and ConstaCore Technologies, a business based in Houston, Texas (“ConstaCore”, “we”, “us”). 1.2 You accept these terms by ticking the box when you create a workspace or join one, or by using ConstaSite. If you accept for a company or other organization, you confirm that you may bind it, and “you” means that organization and the people it lets use its workspace.
1.3 ConstaSite is for business use by people aged 18 or over. If you do not agree to these terms, do not use ConstaSite.
1.4 These terms work with our Privacy Policy and our Data sources and attribution page. Where you buy through Stripe, Stripe’s terms for the payment apply as well (section 4.2).
2. The service
2.1 ConstaSite (the “service”) lets you:
- run site checks: a report on one address or parcel, with the demographics, businesses, risks and plans around it;
- run area searches: find places in a market that meet criteria you choose;
- read an area story: how a place has changed and what public agencies project and plan for it; and
- produce reports (PDF and on screen) from that work.
2.2 We improve the service often. Features, data coverage and limits can change. If a change materially reduces what a paid plan includes during a period you have paid for, we will tell you in advance, and you may cancel and receive a pro-rated refund of the unused part of that period.
2.3 Some features may be marked “preview” or “beta”. They are offered as they are, may change or stop, and are excluded from any commitment in section 9.
3. Accounts and workspaces
3.1 Your account. You sign in through our sign-in provider. Keep your password and second sign-in factor secure, use your own account only, and tell us at hello@constacore.com straight away if you think someone else has used it.
3.2 Workspaces. Work in ConstaSite lives in a workspace. The person who creates a workspace is its first owner. Owners and admins can invite members, give them roles, remove them and manage billing. Members see what their role allows.
3.3 Seats. Each plan includes the number of members shown when you buy it. You may not share one account among several people to get around that number.
3.4 Admin responsibility. The organization behind a workspace is responsible for: who it invites; the roles it grants; its members’ use of ConstaSite under these terms; and the information its members enter. When a member leaves your organization, remove them from the workspace.
3.5 Security steps. We may require owners and billing admins to turn on two-step verification before they make purchases, and we may ask anyone to confirm their email address or identity before giving access.
4. Plans, credits and payment
4.1 What you can buy. ConstaSite is offered as:
- a Free plan, with no card required;
- paid plans, billed monthly or yearly, each including a monthly or yearly allowance of credits and the features shown before you buy;
- credit packs, a set number of credits bought once; and
- single reports, one report bought once without a plan.
The price, what is included, and any expiry are shown before you pay. Prices are in US dollars.
4.2 Payment through Stripe. All payments are taken by Stripe on its hosted checkout page; we never see or store your full card number. Where Stripe acts as the seller of record for your purchase (Stripe Managed Payments), you buy from Stripe, Stripe’s Consumer Terms of Service apply to the payment, and Stripe’s receipt or invoice is your record of the purchase. Otherwise you buy from us and Stripe processes the payment for us. Either way, these terms govern your use of ConstaSite. 4.3 Taxes. Prices exclude sales tax, VAT and similar taxes. Tax is calculated and shown at checkout and collected with the payment where it applies.
4.4 Renewal. Paid plans renew automatically at the end of each monthly or yearly period, at the price then shown for that plan, until you cancel. If a plan’s price goes up, we will tell the workspace’s billing contacts at least 30 days before the renewal at the new price.
4.5 Credits.
- A plan’s allowance of credits is available during its period and ends at the end of that period; unused allowance does not carry over.
- Credits in a pack expire 12 months after purchase.
- A single report does not expire.
- A run that fails on our side does not use a credit; a credit already taken for it is returned.
- Credits have no cash value, belong to the workspace that bought them, and cannot be transferred or sold.
4.6 Cancellation and refunds.- Cancel any time from the billing settings. Cancellation takes effect at the end of the period you have paid for, and you keep access until then. The workspace then moves to the Free plan, and your saved work stays.
- 14-day refund on a first purchase. If you ask within 14 days of your first purchase of a plan, a credit pack or a single report, and you have not used any of what it gave you, we refund it in full.
- Otherwise, no refunds for a part-used period, used credits or a delivered report, except where section 2.2 or 13.3 says so, where the law requires it, or where we choose to make one (for example after a problem on our side).
- What a refund does. A refund goes back to the original payment method through Stripe. When a purchase is refunded in whole or in part, the matching share of the unused credits from that purchase is removed; credits already used are not affected.
- Rights you have under Stripe’s terms or the law are not limited by this section.
4.7 Failed payments. If a renewal payment fails, Stripe retries it and we will tell the billing contacts. You keep full access for 14 days. After that we may make the workspace read-only until a payment succeeds. If Stripe’s retries run out, the plan ends; your saved work is kept, and subscribing again restores the plan.
5. Acceptable use
5.1 You may use ConstaSite for your own business and your clients’ business, under these terms. You agree not to:
- scrape the service: no robots, crawlers or bulk downloading of pages, maps, figures or reports, and no automated access other than features we document for that purpose;
- resell the data: no extracting figures from ConstaSite to build, sell, license or publish a dataset, database, data feed or competing product;
- use any API we offer other than as documented, with your own credentials, within the stated limits;
- get around limits, credits, seats or access controls, or probe, test, overload or disrupt the service;
- copy, change, decompile or reverse-engineer the service’s software, except where the law allows it despite this term;
- remove or hide the source credits, licence notices or “estimate” labels on maps and reports;
- use ConstaSite to break the law, to discriminate unlawfully (including in housing, lending or employment decisions), or to infringe anyone’s rights; or
- upload malicious code, or content you have no right to use.
5.2 We may suspend access that puts the service, its data publishers or other customers at risk. Where we can, we will tell you first and give you a chance to fix the problem.
6. The data, and what reports are for
6.1 Where the figures come from. ConstaSite shows facts drawn from public sources: federal, state, regional and city agencies and other publishers, each credited with the attribution its publisher asks for. Every report names the source, the vintage (the edition of the data) and the licence of each figure it shows. The full list is on our Data sources and attribution page.
6.2 How you may use reports. You may use ConstaSite’s reports, maps and figures for your own business decisions, and you may share reports with your lenders, investors, advisers, clients and partners in the ordinary course of your business. Keep the source credits with any figure you quote outside a report.
6.3 What you may not do with the data. You may not redistribute the underlying datasets, or extract figures in bulk to rebuild them (section 5.1). Some figures come from sources licensed under Creative Commons ShareAlike licences; where you adapt those figures and share them outside a report, that licence applies to them, as the attribution page says.
6.4 Estimates are labelled. Where ConstaSite computes a figure itself (for example a value moved onto today’s boundaries, a daytime population, or a trend band), it is labelled as an estimate and is not the publisher’s figure. A projection or forecast is the named agency’s, not ours.
6.5 Public data has limits. Public sources can be incomplete, late or wrong, and publishers revise them. We check what we import, show its date, and correct errors we find, but we do not promise that any figure is complete, current or correct, or that it fits any particular decision.
6.6 Not advice. ConstaSite gives information to support your own research. It is not legal, tax, financial, investment, lending, engineering or environmental advice. A report is not a survey, an appraisal or valuation, a title, zoning or legal opinion, a flood determination, or an environmental site assessment. Check anything material with qualified professionals and the primary source before you rely on it.
7. Intellectual property
7.1 Ours. ConstaSite, its software, design, report layouts and the way we compile, clean and combine the data belong to ConstaCore or its licensors. While your workspace is in good standing we give you a limited, non-exclusive, non-transferable right to use the service under these terms. We keep every right not given in these terms.
7.2 The publishers’. Public data remains subject to its publisher’s rights and licence. Nothing in these terms gives you, or claims for us, more rights in that data than its licence allows.
7.3 Yours. What you put into ConstaSite (addresses, criteria, names, notes, uploaded files and the like, “your content”) stays yours. You give us the right to host, copy, process and display your content only to run the service for you, to keep it secure, and as the law requires. You confirm that you have the right to give us your content for that purpose.
7.4 Your reports. As between you and us, you own the reports you produce, apart from our software, layouts and the third-party data and maps in them, which you may use as section 6 says.
7.5 Feedback. If you send ideas or suggestions, we may use them without owing you anything. We will not name you without your permission.
8. Confidentiality of your workspace
8.1 We treat your workspace (your content, your searches, saved sites, reports and member list) as confidential. We do not sell it, share it with other customers, use it to build data products, or use it for advertising.
8.2 Our staff look inside a workspace only to provide support you ask for, to keep the service secure, to investigate misuse, or when the law requires it.
8.3 We may use counts of how the service is used, which do not identify you, your workspace or the sites you look at, to run and improve ConstaSite.
8.4 Our service providers process your content only on our instructions, under contracts that require them to protect it (see the Privacy Policy). We may disclose content when the law requires it; where we may, we will tell you first.
8.5 If you share a report link or a report outside your workspace, the people you share it with can see what it shows.
9. Availability and support
9.1 We work to keep ConstaSite available at all times, and we will tell you in advance about planned maintenance that interrupts it. We do not offer a service-level commitment unless we agree one in writing.
9.2 Support is by email at hello@constacore.com. We aim to answer within one business day (Monday to Friday, US Central time, excluding US public holidays).
9.3 The service relies on others: our hosting, sign-in, payment and map providers, and the publishers of public data. We are not responsible for delays or failures caused by events outside our reasonable control.
10. Disclaimers
10.1 Except as these terms expressly say, and to the fullest extent the law allows, ConstaSite and all data, maps and reports are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, title and non-infringement. We do not promise that the service will be uninterrupted or error-free.
10.2 Data publishers and map providers give their data and maps to us without warranty, and they owe you nothing under these terms.
11. Limitation of liability
11.1 To the fullest extent the law allows, neither you nor we are liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, including any loss from a decision to buy, lease, lend on, develop or not develop a site, even if told such loss was possible.
11.2 To the fullest extent the law allows, each party’s total liability for all claims arising from or relating to ConstaSite or these terms is limited to the amount you paid for ConstaSite in the 12 months before the event that gave rise to the claim, or US$100, whichever is more.
11.3 These limits do not apply to: amounts you owe for purchases; your breach of section 5 or 6.3; your obligations under section 12; or liability that the law does not allow to be limited, such as for fraud.
12. Your responsibility for misuse
12.1 If someone outside your organization makes a claim against ConstaCore because of your content, your breach of section 5 or 6.3, or your use of ConstaSite in breach of the law, you will defend us against it and pay the damages and reasonable costs finally awarded against us, or a settlement you agree to in writing.
12.2 We will tell you about the claim promptly, let you control the defence and settlement (you may not settle in a way that admits fault for us or binds us without our consent), and give you reasonable help at your cost.
13. Ending the agreement, and your data
13.1 You can stop using ConstaSite at any time, and close your workspace by emailing us at hello@constacore.com. Closing a workspace ends any paid plan at the end of its period; section 4.6 applies to refunds.
13.2 We may suspend or end your access if you seriously or repeatedly break these terms and, where it can be fixed, do not fix it within 14 days of our notice, or straight away where the law requires it or the breach puts the service, its publishers or other customers at risk.
13.3 If we stop offering ConstaSite, we will give at least 60 days’ notice and refund the unused part of any prepaid period, pack or single report.
13.4 Exporting your work. While your workspace is open you can download your reports at any time, and we will export your saved sites and searches for you in a common file format on request. If an owner asks within 30 days after a workspace is closed, we will still provide that export. We will delete a closed workspace’s content within 90 days of closure, except records the law requires us to keep (such as payment and tax records, kept up to 7 years) and security logs; records we keep about a deleted workspace are anonymised where we can.
13.5 Sections 4 (amounts owed), 5, 6, 7, 10, 11, 12, 13.4, 15 and 16 continue after the agreement ends.
14. Changes to these terms
14.1 We may update these terms. Each version has a version string and an effective date at the top, and we will provide earlier versions on request.
14.2 For a material change, we will tell workspace owners and admins by email and in the service at least 30 days before it takes effect, and ask each member to accept the new version the next time they sign in after that date. If you do not agree, you may close your workspace before the change takes effect and receive a pro-rated refund of the unused part of any prepaid period.
14.3 Changes needed by law, or that only add features or fix wording, may take effect sooner.
15. Governing law and disputes
15.1 These terms are governed by the laws of the State of Texas and applicable United States federal law, without regard to conflict-of-law rules.
15.2 Talk to us first. Before starting a court case, the party with the complaint will write to the other (to us at hello@constacore.com) describing it and what would settle it, and both of us will try in good faith to resolve it within 60 days. This does not stop either party seeking urgent court relief to protect its rights or data.
15.3 Courts. Any dispute that is not resolved goes to the state or federal courts located in Harris County, Texas, and both parties agree to their jurisdiction, unless the law where you are based gives you a right to bring the claim elsewhere. Either party may bring a qualifying claim in small claims court instead.
15.4 Nothing in these terms waives your right to bring or take part in a class or representative action.
16. General
16.1 Whole agreement. These terms, with any order form or written agreement we sign with you, are the whole agreement about ConstaSite. If they conflict, the signed agreement wins.
16.2 Assignment. You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of the business, and will tell you if we do.
16.3 Notices. We send notices to the email addresses of the workspace’s owners and admins and in the service. You send notices to hello@constacore.com.
16.4 No waiver; severability. Not enforcing a term is not a waiver of it. If a court finds a term unenforceable, it is changed to the minimum extent needed, and the rest stays in force.
16.5 Independent parties. These terms create no partnership, agency or employment between you and us.
16.6 Export and sanctions. You may not use ConstaSite where US law forbids it or if you are on a US sanctions list.
16.7 US government users. The service is commercial computer software and documentation provided under these terms.
